General terms and conditions for the sale of Pomi d’Umbria

(hereinafter also referred to as www.pomidumbria.it)

Product prices, contents and availability

All prices indicated on the website are vat inclusive.

Prices and availability indicated in this store are subject to stock-out or changes due to market conditions or other factors.

Discounts, coupons and promotions cannot be combined.

Price validity and order confirmation by email

By submitting an order form you will receive automatic order confirmation by email. The price applied will be the price set at the time of your order. It is possible, however, that some offers or items may have sold out in the meantime or undergone particularly significant price changes, in which case we will contact you immediately to cancel the order or give you necessary instructions.

Responsibility

It is understood that www.pomidumbria.it shall have no responsibility with regard to the intended use by the customer of the goods purchased. In the event of faulty or broken goods www.pomidumbria.it shall arrange for them to be collected in a timely manner, at its own expense, and shall send replacements. Www.pomidumbria.it shall in all cases bear the costs of repairs or replacements, at its own discretion. Under no circumstances shall www.pomidumbria.it be held responsible for lost earnings due to the inability to use products purchased. Order processing and returns Products found to be missing from the package, in whole or in part, or any damage incurred during transport, must be declared within 2 days of receipt of the package (as well as by email). When the goods are delivered by the courier, the customer will be required to check that the packaging is completely intact, not wet or damaged, and that materials used to seal it are also intact, otherwise he/she should immediately notify the courier of any damage by stating on the accompanying delivery receipt “subject to inspection” (countersigned by the courier) followed by an e-mail to prodotti@pomidumbria.it.

Delivery methods and timelines

www.pomidumbria.it  - use  couriers that offer a speedy, guaranteed service.

The average shipment times in Italy are 4-6 working days from the order date (excluding Saturdays, Sundays and Bank Holidays). However, this may vary on grounds of force majeure, such as bad weather and strikes. For EU countries the average times are 5-15 working days. For countries outside the European Union, shipment times will be agreed each time.

Deliveries are carried out from Monday to Friday during normal office hours, excluding national bank holidays. The products will be delivered to the address specified at the time of order.

At the time of purchase, it is extremely important to give a current telephone number and e-mail address to enable the courier to contact you and optimise delivery procedures.

Shipment costs

www.pomidumbria.it applies the following shipment costs:

• Italy - Shipment cost EUR 9,00 throughout Italy for orders up to EUR 150,00. For purchases over EUR 150,00, shipment is free of charge.
  These tariffs are valid exclusively in Italy.
• For EU countries - shipment costs are EUR 30,00.

Shipment costs via courier for the area outside the EU vary and are calculated by our customer service department that will notify the customer via e-mail or telephone.

Terms and conditions of payment

Paypal is a totally secure online payment method allowing you to pay for your order by accessing your account directly. Your account and credit card details will be handled directly by Paypal, and we will be notified by email when payment has been made.

When confirming your order, simply select the “Credit Card or Paypal” payment option to be directly transferred to the PAYPAL site, where you can enter your email and password to access your Paypal account and complete payment.

With Paypal it is also possible to pay directly using your credit card.

To pay by bank transfer to our account, please use the following details

There is no cash on delivery option.

By choosing this method, orders will only be finalized once payment has been made  into the bank account. Shipping times will be calculated from time of payment.

Returning  goods and right of withdrawal  

If the customer is a natural person acting for personal purposes, and not for business, commercial, craft or professional activities, he/she has the right to withdraw (i.e. cancel) purchase contracts within 14 days of receiving the products. This right is provided for in the Legislative Decree, known as the “Consumer Code,” which implements the European Directive 2011/83/EU on consumer rights, effective June 14, 2014.

Customers may exercise Right of Withdrawal by providing written notice to www.pomidumbria.it, sending an email to the address indicated on the contact page : contatti prodotti@pomidumbria.it, containing:

• the intention to exercise the right of withdrawal ;
• indicating the order number that led to the Purchase and Sales Contract from which the customer intends to withdraw

In this case shipping costs to return the goods shall be borne by the customer.

In case of withdrawal due to product breakage or damage, both the costs of returning and, subsequently, re-sending the goods shall be borne by Pomi d’Umbria.
